Summary: Two bills, June 11 and Sept. 18, 1756, submitted by Capt. Timothy Houghton to the province of Massachusetts and its agent or paymaster, Samuel Livermore, both for military transportation in the region north of Albany, N.Y. The first, certifying that Albert Vanderwerken carried four wagon loads of provisions from Halfmoon to Stillwater, contains Vanderwerken’s June 26 note that he had been paid in full. The second bill is for wages to "men hereafter named for Battowing from Albany to Halfmoon." Its payment is confirmed by Houghton in Boston on Feb. 3, 1757.

Captain Timothy Houghton, JP, the public magistrate of Chester township, Nova Scotia, was publicly prosecuted for slandering the King in 1777. It was the most important of sanctioned disloyalty in the New England Planter townships along Nova Scotia's South Shore. Houghton, who was the chief agent and expediter of the "Shoreham" township of 1759, deserved to be regarded as the founder of Chester and was a former Massachusetts provincial officer of wide military experience. "The proprietors choice of him as moderator of the inaugural town meeting in August 1761 was implicitly approved by the government seven months later, when Houghton was commissioned justice of the peace, which he remained until 1764. Houghton acted as surveyor and proprietor's clerk, was captain of the militia and officer commanding the militia within the township. Only one magistrate of the South Shore -Timothy Houghton - was actually tried for "high misdemeanour", and while he was found guilty, fined, imprisoned, and decommissioned, official forgiveness for breaking allegiance was granted upon his retaking the oath." His trial in the Supreme Court in Feb. 1777 on charges of calumny against the king. The government was compelled to prosecute him in order to legitimize dismissing him. His case was only 1 of 2 prosecutions for sedition by the government of Nova Scotia during the entire Revolutionary War. He was a Congregationalist and a republican. He was a partner of a sawmill with Phillip Knaut, his closest business partner and creditor. Houghton refused to take a new oath of allegiance to the King in 1775. He was indicted, arraigned, and tried in Feb. 1777 in Halifax in R. v. Houghton. He was accused of "constant opposition" to the government was animated by whig-patriot, "constitutional republican attitudes toward the Quebec Act. Four of his loyalist Anglo-American Chester neighbors testified against him in Dec 1776-Jan 1777. The government wanted to punish him as a deviant magistrate. He pleaded not guilty but was convicted. He was sentenced to 6 months in prison and fined 50 pounds. After 2 months he petitioned for release, took the oath to the King, and pledged good behavior for a year. With his conviction, he was decommissioned as justice of the peace. He returned to Chester and worked at this sawmill until his death 3 years later. He remained moderator of the town meeting. His militia captaincy was removed. He had served during the French and Indian War. His trial was an example of the criminalization of political dissent. Houghton was dissent portrayed as sedition.

In 1755 the Crown Point, Lake Champlain expedition was inaugurated and a regiment of 800 men raised under the Coloneley of Samuel Willard, jr., whose Lieut. Col. was John Whitcomb, who after the demise of Col. Willard, jr., took command of this regiment of which Timothy Houghton was adjutant. In 1756 Captain Timothy Houghton of Col. Jonathan Bagley's command led a company largely recruited by his Lieut. from Waltham and Newton, Mass. Linda Scott: Capt. Timothy Houghton emigrated to Nova Scotia in the 1750s at the time that the "Foreign Protestants" were being recruited to colonize the area, enduring great hardships (apparently it was a difficult sell, as emmigrants tended to favor the New England colonies where conditions were not quite so harsh.) I note that there is an article on the "Timothy Houghton Sedition Trial" in Acadiensis, 1971

John Cardinal: Timothy Houghton was born on 21 August 1727 at Bolton, Massachusetts.1 He was the son of Jacob Houghton Jr. and Mary Willard. Timothy, age 26 married Eunice Whitcomb, age 20, daughter of Deacon David Whitcomb and Betty White, on 10 December 1753 (Eunice's birthday) at Lancaster, Worcester County, Massachusetts.2 Timothy Houghton was one of the founders of Chester, Nova Scotia; he obtained one hundred thousand acres of land for himself and fifty-two others.3,4 He and Eunice Whitcomb left Boston, Massachusetts, on 30 July 1759 and arrived in Chester, Nova Scotia, on 4 August.3 Timothy Houghton was sentenced to six months in jail for seditious statements about the King. He "said the King had broke his Coronation Oath by establishing the Roman Catholic Religion at Quebec and that he could not in conscience serve his Majesty, etc. etc." He served two months of his sentence and was released on 10 February 1777.5 He died on 10 May 1780 at Halifax, Nova Scotia, at age 52 of small-pox.3,4,6

He began soldiering young, and served from April to November, 1754, on the eastern frontier in Captains Osgood and Marwin's companies in Col. John Winslow's regiment. In the Crown Point Expedition Aug. 9, 1755, he was adjutant in Col. Samuel Willard's regiment. In 1756, Captain Houghton of Col. Jonathan Bagley's command led a company largely recruited by his lietenant from Waltham and Newton, Mass. While in the east Captain Hougton saw Nova Scotia for the first time, and subsequently obtained one hundred thousand acres for himself and fifty-two others.
Captain Houghton married Eunice Whitcomb before 1753. They left Boston, Massachusetts July 30, 1759, and arrived in Chester, Lunenburg Co., Nova Scotia on Aug. 4.

A sailing journal kept by passenger Rev. John Seccombe recorded daily events showing that the party set sail Thursday 30 July 1759 and arrived at Chester the following Tuesday. He did not name the vessel but he did record the passengers names in addition to captain and mate. The reverend also provides a daily brief account of activities including an event where "Mr. Houghton's calf jumped overboard but was saved..."

Captain Houghton died of small pox in Halifax, May 10, 1780.7,8,25,26,27,15,28

Notes:      Simon Houghton (1737-1814) and Martha Stearns Houghton (1750-1823) resided in Bolton, Mass. Their children included: Timothy (1771-1837), studied law but became a farmer; Simon (1773-1814); Asa (1775-1829), an almanac maker; Jacob (1777-1861), a lawyer and judge; Dinah (1778-1786); Martha (1781-1818); Mary (1784-1818); Samuel S. (1786-1865), a teacher; Daniel E. Stearns (1788-1825), a lawyer; Josiah (1790-1833), a lawyer; and Abigail (1792-1847).
This collection consists mostly of letters from the children to their parents and to each other. The letters concern family matters, particularly finances, and contain information about marriages, births, deaths, and occupations. Several letters concern the division of Simon's estate after his death. Also included are miscellaneous letters from acquaintances of the family, land deeds, and a few other miscellaneous legal papers.
At the end of this collection is included a genealogical chart, compiled by J. C. L. Clark (1871-1936), and two Clark letters, dated 1927, concerning the Houghton family.

They dammed up Schenevus Creek (Chaseville) but since it flooded the flats, they tore it down and built one closer to Spencer's Grist Mill. Jotham and his sons Jerahmeel and Daniel were the first settlers near where Chaseville is now located.

ResearchThe Keene Charter of 1753




The charter, dated April 11, 1753, issued by Benning Wentworth, Governor of His Majesty's
Royal Province of New Hampshire, with consent of the Council, may be regarded as the "birth
certificate" of the City of Keene, New Hampshire. By this document the representative of
England's King George II, granted authority to inhabitants of Upper Ashuelot to institute a
governmental structure and carry on town business under the dominion of New Hampshire.

Pioneers had ventured into this place 17 years earlier and had established homes and created a
settlement under the authority of the Massachusetts Bay Colony of which most were natives. In
1740, however, the boundary line between Massachusetts and New Hampshire was drawn by
royal decree, leaving Upper Ashuelot outside Massachusetts jurisdiction. Together with
neighboring settlements, the people here had to petition royal authorities in Portsmouth, the seat
of New Hampshire's provincial government, for formal incorporation in order to operate as a
New Hampshire township, to establish municipal institutions, and to protect title to their lands.

Gov. Wentworth's document recognizes the earlier settlement, but imposes upon it a new name,
Keene. It contains a detailed geographic description on the order of a deed. The town at this
time contained 39.45 square miles, or 25,248 acres. A number of requirements under New
Hampshire royal authority are outlined, among these lands reserved for a church and a school,
support of the first settled minister, as well as land reserved for the benefit of the Church of
England and its missionary organization. Sixty-two named grantees are required to occupy and
improve the Town Lots divided among them, and are given permission to keep a public market
one or more days a week when fifty or more families are settled. All white pine trees are
reserved for the royal navy. Benjamin Bellows is named moderator of the first town meeting
which was held May 2, 1753 in the fort located on lower Main Street. Keene's history as a
Granite State community begins with the charter of 1753.

The charter is on parchment, lettered with some care and bears the province's royal wax seal as
well as Wentworth's signature and that of Theodore Atkinson, Secretary. On the back is a plan
of the territory. The text is recorded in the "Book of Charters" at the New Hampshire State
Archives, pp. 149-152, and is published in the "New Hampshire State Papers" series in
Griffin's 1904 History of the Town of Keene, pp. 104-108. The proprietors' copy, in the
custody of a succession of Town and City Clerks over a period of 245 years, appears to be in
good condition, long kept, folded, in the original record book of the New Hampshire
proprietors. At some later date, probably under Frank Whitcomb, the proprietors' book was
preserved by placing its pages between fine silk in a new binding. The charter was removed,
and perhaps framed; a photograph of the document has been on display. It was finally laid in the
bottom of a desk or table drawer within the vault where it remained unnoticed for some years.
It was not recognized, as far as I can determine, in 1953 when Keene celebrated its
bicentennial. Discovered, probably when Mrs. Knight was Clerk, it was taken by authority of
the mayor and council by David Proper to the Boston museum of Fine Arts early in March 1973
for professional conservation which included cleaning, deacidification, and laminating with a
fine quality Japanese paper.

To all Persons to whom these Presents Shall come Greeting
Whereas Sundry of our Loveing Subjects before the Settlement of the Dividing Line of our
Province of New Hampshire aforesaid and our Other Government of the Massachusetts Bay had
by Permission of our Said Government of the Massachusetts Bay begun A Settlement of A Tract
of Land on Ashuelot River so Called and made Sundry Divisions of & Improvements upon the
Said Tract of Land And there remain'd till the Indian Warr forced them off and our Said
Subjects being Desireous to make an Immediate Settlement on the Premisses & haveing
Petitioned our Governour in Council for his Majestys Grant of the Premisses to be so made as
might not subvert & Distroy their former Surveys & Laying out in severalty made thereon as
aforesaid Now Know Ye that we of our Especial Grace Certain Knowledge & mere motion for
answering the Ends above said and for the Due Encouragement of Settling the Said Plantation by
& with the Advice of our Trusty & wellbeloved BENNING WENTWORTH Esq our

Province of New Hampshire Containing by admeasurement Twenty three thousend & forty
Acres which Tracts is to Contain Six Miles Square & no more out of which an allowance is to
be made for highways and unimprovable Land by Rocks Mountains Ponds & Rivers One
thousend & forty Acres free According to a Plan thereof made & Presented by our Said
Governours orders And hereunto Annexed Butted & bounded as follows -- Viz -- Beginning at a
Beach Tree the North West Corner & Runs South Six Degrees an an half East four miles &
Seventy rods to A Beach Tree marked Thence runs East Ten Degrees & a half South Six miles
& one hundred & Eighty Rods to A heap of Stones thence runs North Seventeen degrees East Six
Miles & Eighty Rods to A Tree marked being the South East Corner of Boyle thence runs West
five Degrees and an half South Eight Miles & Two hundred & fifty rods to the Bounds first
mentioned And that the Same be and hereby is Incorporated into A Township by the name of
Keene and that the Inhabitants that Do or Shall hereafter Inhabit the Said Township Are hereby
Declared to be Enfranchized with and Intituled to all & every the Previliedges and Immunities
that Other Towns within our Said Province by Law Exercize & Enjoy and further that the Said
Town as Soon as there Shall be fifty families Shall have the Liberty to open & keep A Market
one or more Days in Each week as may be thot most Advantagious to the Inhabitants also that the
first Meeting for the Choice of Town officers & other affairs Agreable to the Laws of our Said
Province Shall be held on the first Wenesday in May next which Meeting Shall be Notifyed by
Mr Benjamin Bellows who is hereby Also Appointed the Moderator of the said first Meeting
which he is to Notify & Govern Agreable to the Law & Custom of our Said Province And that
the Annual Meeting for ever hereafter for the Choice of Such officers for the Said Town Shall
be on the first Tuesday in March annually -- To HAVE & TO HOLD the said Tract of Land as
above Expressed togeather with all Previledges and Appurtenances to them or their respective
heirs and assigns forever upon the following Conditions (Viz) that every Grantee his heirs &
assignes Shall Plant or Cultivate five Acres of Land within the Term of five years for every fifty
Acres Contained in his or their Share or Proportion of Land in the Said Township & Continue to
Improve & Settle the same by Aditional Cultivations on Penalty of the forfeiture of his Grant or
Share in the said Township and its reverting to his Majesty his heirs and Successors to be by
him or them regranted to Such of his Subjects as shall Effectually Settle & Cultivate the Same --
That all white & other Pine Trees within the Said Township fit for masting our Royal Navy be
Carefully Preserved for that use & none to be Cutt or fell'd without his Majesties Especial
Lycence for so Doing first had & obtained upon the Penalty of the forfeiture of the right of Such
Grantee his heirs or assigns to us our heirs and Successors as well as being Subject to the
Penalty of any Act or Acts of Parliament that now are or hereafter Shall be Enacted.
That before any further Division of the Said Land be made to and amoungst the grantees A Tract
of Land in the most Comodious Place the Land will admit of Shall be reserved & marked out for
Town Lotts one of which shall be allotted to Each Grantee of the Contents of one Acre Yeilding
& Paying therefor to us our heirs & Successors for the Space of Ten years to be Computed from
the Date hereof the rent of One Ear of Indian Corn only on the first day of January next Ensueing
the Date hereof -- And every Proprietor Settler or Inhabitant Shall Yield & Pay unto us our heirs
& Successors Yearly & Every Year for ever from & after the Expiration of the Ten years from
the Date hereof Namely on the first Day of Janry which will be in the Year of our Lord Christ

The information provided for the last four children Lucy, Sally, Joel, and Ezra, matches closely with children of Benjamin Houghton (1771-1819) and Dinah (Houghton) Houghton (1727-abt.1793).
Children Sampson, Henry, and Richard were settlers in New York. Census and other records list their births most frequently as Connecticut (sometimes Rhode Island, or New York). They more often used the spelling Haughton.

Descendant Bryant Haughton believes that a large Haughton family originates from this line, particularly for Sampson, Henry, and Richard.

Then Martha Snow (dau of John) is christened, p 290, ibid. That would explain how Martha Snow could give birth to Benjamin in 1784 + or -.8
